The FCC Postpones a Major Rule—Here’s What You Need to Know

If you’ve been worried about the January 27, 2025 deadline for the FCC’s revised rule 64.1200(f)(9), we’ve got good news. The FCC is hitting the pause button, moving the effective date to January 26, 2026 (or earlier, pending court review). Watch Now!
Why the delay? It’s all about ensuring businesses, especially small ones, don’t face unnecessary burdens during a time of uncertainty.
Here’s what’s happening:
Legal challenges: The Insurance Marketing Coalition (IMC) is pushing back against the rule, with oral arguments just wrapped up in December 2024.
Compliance headaches: Stakeholders raised red flags over high costs, competitive risks, and the complexity of “one-to-one” consent requirements.
A smarter approach: The FCC wants to avoid disrupting businesses while waiting for the court’s decision.
What does this mean for you?
For now, everything stays the same. The current TCPA rules for prior express written consent are still in effect. If the court upholds the rule, you’ll get at least 90 days to prepare for the changes.
